Terms For Supply

Terms and conditions that apply to products ordered through this site.

These Terms of Supply apply to all products, subscriptions, gift subscriptions, gift cards and other items purchased from Knobby through our website, app, retail stores or any other sales channels operated by us.

By placing an order with us, creating an account, joining the Undie Club, purchasing a gift subscription or gift card, or otherwise buying products from us, you agree to these Terms of Supply.

These Terms should be read together with our Privacy Policy, Returns & Refunds Policy, Shipping Policy, Promotions Terms and Website Terms of Use.

1. Who We Are

In these Terms:

  • “Knobby”, “we”, “us” or “our” means Knobby Pty Ltd ACN 642 010 062.
  • You can contact us at support@knobby.com.au.

2. Definitions

In these terms:

Australian Consumer Law means Schedule 2 of the Competition and Consumer Act 2010 (Cth).

Consumer Guarantees means the guarantees that apply under the Australian Consumer Law.

Products means all goods, subscriptions, gift subscriptions, gift cards and any other products sold by Knobby.

Site means any website, mobile application or online service operated by Knobby.

Undie Club means Knobby’s recurring monthly underwear subscription.

Underwear Unit means each individual underwear style included within your subscription.

3. Eligibility

You must be at least 18 years old to place an order or join the Undie Club.

Products are sold for personal use only unless otherwise agreed by us in writing.

You must not reproduce, copy, modify, distribute or commercially exploit any Knobby products, artwork, designs, photography, branding or intellectual property without our written consent.

You agree that all information you provide is accurate, complete and up to date.

We may refuse or cancel an order or suspend an account if we reasonably believe information supplied is inaccurate, fraudulent or in breach of these Terms.

4. Orders

Submitting an order constitutes an offer to purchase the Products shown at checkout.

All orders are subject to acceptance by Knobby.

We may refuse or cancel any order where:

  • Products become unavailable.
  • There is a pricing or website error.
  • Payment cannot be processed.
  • We reasonably suspect fraud or misuse.
  • The order breaches these Terms.

If we cannot supply a Product, we may offer a refund, store credit or substitute Product.

You are responsible for checking all order details before placing an order.

5. Pricing & Payment

Prices displayed on our Site are shown in the applicable currency and include GST where required by law unless stated otherwise.

Shipping charges, taxes and duties may apply and will be displayed during checkout where applicable.

Payment must be received in full before Products are shipped.

Prices may change at any time, however changes will not affect orders already accepted by us.

6. Shipping & Delivery

Products will be shipped to the delivery address supplied during checkout.

Delivery timeframes are estimates only and are not guaranteed.

Risk in the Products passes to you upon delivery to your nominated delivery address or collection point.

You are responsible for ensuring your delivery details are correct.

If an order is delayed, lost or damaged during transit, please contact us and we will work with the carrier to resolve the issue.

7. Checking Your Order

Please inspect your order as soon as possible after delivery.

If you receive incorrect, damaged or defective Products, please contact us promptly with your order number and photographs where appropriate.

Nothing in these Terms limits your rights under the Australian Consumer Law.

8. Undie Club

The Undie Club is a recurring monthly subscription service.

When you subscribe, you authorise Knobby to automatically charge your nominated payment method each month for your selected subscription Products, together with any applicable shipping charges, taxes or other fees.

The Undie Club is available on a monthly basis only. Subscription frequencies such as every second month, every third month or every fourth month are not available.

Your subscription continues until cancelled by you or terminated by us in accordance with these Terms.

There is no lock-in contract and you may cancel your subscription at any time.

You can cancel your subscription by emailing support@knobby.com.au or through your customer account at www.knobby.com.au/account.

To avoid being charged for your next monthly order, your cancellation must be completed before 9:00pm Queensland time (AEST) on the 7th day of the month, when your monthly order is locked for processing. If your order has already been locked, your cancellation will take effect from your next monthly order.

9. Monthly Reveal & Order Timeline

Each month you may be given the opportunity to reveal a sneak peek of that month’s Club design before your order is processed.

You may choose to reveal the design or keep it a surprise.

The monthly decision period begins on the 1st day of each month.

The decision period closes at 9:00pm Queensland time (AEST) on the 7th day of each month.

Before this deadline you may:

  • Reveal the monthly design.
  • Keep the design a surprise.
  • Use available skip tokens.
  • Remove individual underwear units.
  • Add eligible underwear units (subject to availability).
  • Update your subscription.
  • Cancel your subscription.

At 9:00pm Queensland time (AEST) on the 7th day of each month, your subscription order is locked.

Payment will then be processed for all underwear units that have not been skipped, removed or cancelled.

If payment is successful, your Products will generally be dispatched within 5 business days.

This monthly processing schedule applies to all Undie Club members regardless of when they originally joined.

If you join the Undie Club after the 7th day of a month, your first pair will generally be dispatched within 3 business days, after which your subscription will move onto the standard monthly schedule beginning the following month.

If your order has already been locked before you cancel, remove an item or use a skip token, those changes will instead apply to your next monthly order.

10. Subscription Management

You may manage your subscription through your customer account.

Subject to availability, you may:

  • Add underwear units.
  • Remove underwear units.
  • Change size.
  • Update shipping details.
  • Update billing information.

If you remove an underwear unit from your subscription, that subscription allocation may immediately become available to another customer.

Once removed, Knobby cannot guarantee that the same underwear unit will be available to rejoin in the future.

Similarly, if you cancel your entire subscription, your subscription allocation may become available to another customer.

Please note that removing an Underwear Unit from your subscription may permanently forfeit any grandfathered pricing that applies to that Underwear Unit. If you later add the same Underwear Unit back to your subscription, the current subscription price at that time will apply.

11. Skip Tokens

To ensure fair access to the Undie Club, the number of active subscription places and underwear units is capped.

Because subscription places are limited, skip tokens help balance the flexibility of existing members with the opportunity for new customers to join the Undie Club. Without reasonable limits on skips, customers could indefinitely reserve subscription places without receiving products, preventing others from joining.

Each Underwear Unit receives:

  • 2 skip tokens when first subscribed.
  • 1 additional skip token after every 6 months of continuous active subscription.

For example, after maintaining a subscription for 12 months, an Underwear Unit will have received a total of 4 skip tokens:

  • 2 upon joining.
  • 1 after 6 months.
  • 1 after 12 months.

Each Underwear Unit maintains its own skip token balance. For example, if your subscription contains a Men’s Trunk, a Women’s Bralette and a Women’s Bikini, each Underwear Unit has its own independent skip token allocation.

Skip tokens:

  • May only be used on the Underwear Unit to which they relate.
  • Cannot be transferred between units, subscriptions or customers.
  • Cannot be exchanged for cash or credit.
  • Have no monetary value.

If you have no skip tokens remaining for a particular Underwear Unit, you may either receive that month’s Product or remove that Underwear Unit from your subscription. If you remove an Underwear Unit, the subscription place for that unit may become available to another customer and may not be available to you again in the future.

Knobby may adjust subscription caps or skip token rules from time to time. Where changes materially affect existing subscriptions, we will provide reasonable notice.

Nothing in this section limits your rights under the Australian Consumer Law.

12. Payment Issues

Automatic payments may fail for various reasons, including insufficient funds, expired payment methods, payment provider issues or bank declines.

If payment fails after your monthly order has been locked, we may retry your nominated payment method periodically over the following 30-day period.

During this period we may also:

  • Contact you to update your payment details.
  • Temporarily withhold shipment.
  • Pause your subscription while payment is outstanding.

If payment has not been successfully completed within 30 days, we may cancel your subscription.

You remain responsible for payment of any order that has already been processed or dispatched prior to cancellation.

13. Subscription Price Changes

We may change subscription pricing from time to time.

If a price increase applies to an existing subscription, we will provide reasonable notice before the change takes effect.

If you do not wish to continue at the new price, you may cancel your subscription before the new pricing becomes effective.

14. Grandfathered Pricing

From time to time, Knobby may offer different subscription prices for Underwear Units. As a result, some customers may have different pricing depending on when each Underwear Unit was originally added to their subscription.

If an Underwear Unit in your subscription is on a grandfathered price, that price will continue to apply for as long as that Underwear Unit remains active in your subscription and your subscription remains in good standing.

If you remove an Underwear Unit from your subscription or cancel your subscription, you will permanently forfeit any grandfathered pricing that applies to that Underwear Unit.

If you later add the same Underwear Unit back to your subscription, it will be charged at the subscription price available at the time it is re-added, unless we expressly advise otherwise.

Grandfathered pricing applies only to the specific active Underwear Unit to which it relates and cannot be transferred between Underwear Units, customers, accounts or new subscriptions.

15. Gift Subscriptions & Gift Cards

Gift subscriptions, gift cards and vouchers may be subject to additional terms displayed at the time of purchase.

They are not redeemable for cash except where required by law.

Where legally permitted, expiry dates will be displayed at the time of purchase.

Knobby is not responsible for lost, stolen or unauthorised use of gift cards or gift subscription codes except where required by law.

16. Promotions

Promotions, referral offers, discount codes and loyalty rewards are subject to the specific terms applicable to that promotion.

Unless otherwise stated:

  • Only one promotion may be used per order.
  • Promotions cannot be applied after an order has been placed.
  • Promotions cannot be exchanged for cash.
  • Knobby may withdraw or amend promotions where reasonably necessary, including in cases of error, misuse or fraud.

17. Returns & Refunds

Our Returns & Refunds Policy forms part of these Terms.

Because underwear is an intimate product, change-of-mind returns may be restricted for hygiene reasons unless otherwise stated.

Nothing in these Terms limits your rights under the Australian Consumer Law.

If a Product has a major failure, you may be entitled to a refund or replacement.

If a Product has a minor failure, we may choose to replace or refund the Product in accordance with the Australian Consumer Law.

18. Consumer Guarantees

Our Products come with guarantees that cannot be excluded under Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

Nothing in these Terms excludes any rights you have under law.

19. Product Information

We make every reasonable effort to ensure Product descriptions, photography, colours, pricing and availability are accurate.

Actual colours may vary between devices.

Knobby may discontinue Products, correct errors or update Product information without notice.

20. Intellectual Property

All intellectual property appearing on our Site, including artwork, photography, logos, branding, copy, graphics, product names and designs, remains the property of Knobby or its licensors.

Nothing in these Terms transfers any intellectual property rights to you.

21. Privacy

We collect, use and disclose personal information in accordance with our Privacy Policy.

22. Events Beyond Our Control

Knobby is not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, pandemics, strikes, carrier delays, supply shortages, cyber incidents or government action.

23. Liability

To the maximum extent permitted by law, Knobby excludes liability for indirect or consequential loss, including loss of profits, revenue, goodwill or business opportunity.

Nothing in these Terms limits any liability that cannot legally be excluded.

24. Account Misuse

We may suspend or cancel accounts, subscriptions, rewards or promotions where we reasonably believe there has been fraud, misuse, abuse of promotions, payment fraud or other conduct harmful to Knobby or its customers.

25. Changes to These Terms

We may update these Terms from time to time.

The version published on our Site at the time your order is accepted applies to that order.

Where changes materially affect ongoing subscriptions, we will provide reasonable notice.

26. Complaints & Disputes

If you have a question or complaint, please contact us at support@knobby.com.au.

We will use reasonable efforts to resolve any dispute in good faith before either party commences legal proceedings, except where urgent legal relief is required.

27. Notices

We may provide notices by email, website notification, customer account notification or SMS using the contact details you have provided.

28. Governing Law

These Terms are governed by the laws of Queensland, Australia.

Any disputes are subject to the non-exclusive jurisdiction of the courts of Queensland.

If any provision of these Terms is found to be unenforceable, the remaining provisions continue to apply.

A failure by Knobby to enforce any right under these Terms does not constitute a waiver of that right.
